1. ELIGIBILITY: This Sweepstakes (“Sweepstakes”) is open to all legal residents of New England (MA, NH, CT, ME, VT, and RI) that are twenty-one (21) years of age or older as of the date of entry. The Sweepstakes is void where prohibited by law. Employees of Wynn MA, LLC (“Sponsor”), Beasley Media Group, LLC d/b/a WBZ-FM, and each of their affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each of the foregoing are not eligible to participate in the Sweepstakes. The term “you,” as used in these terms and conditions, means any person who submits an entry.

2. AGREEMENT TO RULES: By participating, you agree to be fully and unconditionally bound by these terms and conditions, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.

3. DATE OF SWEEPSTAKES: The Sweepstakes begins at 10:00 a.m. on November 9, 2022, and ends at 6:00 p.m. on December 1, 2022. Sponsor’s database computer is the official time-keeping device for this Sweepstakes.

4. REGISTRATION: To enter, access encorebostonharbor.com/patsvegas and follow the prompts and answer the required questions to submit your entry, which must include a designated code word (heard on-air on radio station 98.5 The Sports Hub). Multiple designated code words will be announced at different times during the date of the Sweepstakes, and you may submit an entry each time you hear a different designated code word. You may use each designated word code to submit one (1) entry. All entries must be received between 10:00 a.m. Eastern time on November 9, 2022 and 6:00 p.m. Eastern time on December 1, 2022.  Alternate entries by regular mail will also be accepted.  Mail entries must be postmarked by November 28, 2022 and received by November 30, 2022 to be eligible and must include your name, telephone number, mailing address, and e-mail address.  All entries by mail must be sent to: Sweepstakes Entry, ATTN: Joe Zarbano, Director – Sponsorships, Encore Boston Harbor,1 Broadway, Everett, MA 02149.  Limit one mail entry per envelope. Sponsor is not responsible for late, lost, incomplete, corrupted, misdirected entries, or for computer or computer network errors at any point. Use of automated devices or “bots” is prohibited. Sweepstakes entries become the property of Sponsor and will not be returned.  If you use fraudulent methods or otherwise attempt to circumvent these Official Rules, your submission may be removed from eligibility at the sole discretion of Sponsor.      

5. PRIZES: One (1) potential winner will be randomly drawn from all eligible entries received. The winner will receive: 

• Roundtrip Airfare for two (2) on a private charter flight with New England Patriots alumni, guests and team executives, departing from T.F. Green Airport in Warwick, Rhode Island on December 16, 2022, and returning on December 18, 2022 (specific departure and return times as determined by Sponsor)
• Two (2) Night Stay at Wynn Las Vegas the nights of December 16, 2022 and December 17, 2022 (single room, double occupancy)
• Two (2) Tickets to see the New England Patriots play the Las Vegas Raiders at Allegiant Stadium on December 18, 2022 (seating to be determined by Sponsor in its sole discretion)
• Entry to the New England Patriots VIP welcome reception in Vegas
• Entry to the New England Patriots VIP Pre-game Party at Wynn Las Vegas
• Merchandise Bags including Patriots memorabilia and apparel
• VIP transportation to and from the airport, hotel and stadium
• Meet and Greet with Scott Zolak and New England Patriots broadcast team

Total approximate retail value of the prizes: $12,500

No cash or other prize substitution will be permitted except at Sponsor's discretion, including Sponsor’s right to substitute a prize of equal or greater value if the advertised prize is unavailable. All prizes are nontransferable.  The winner shall be solely responsible for any and all prize-related expenses and fees, including, without limitation, any and all federal, state and/or local taxes (including sales tax).  The potential winner shall be responsible, where applicable, to complete and execute an IRS Form 1099 and release and waiver liability form in order to receive the prizes, which may require the potential winner to provide his or her Social Security number for purposes of the same, within forty-eight (48) hours of receipt. Subject to verification of eligibility and compliance with these terms and conditions, including verification that the winner is twenty-one (21) years of age or older, the potential winner will be declared an official winner of the Sweepstakes. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older prior to winner notification, then the potential winner will be disqualified and an alternate potential winner will be randomly selected.

The prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

6. ODDS: The odds of winning depend on the number of eligible entries received. 

7. WINNER SELECTION & NOTIFICATION:  All prizes will be awarded. The potential winner of the Sweepstakes will be selected in a random drawing under the supervision of Sponsor on December 2, 2022. The potential winner will be notified via  phone call and by email to the phone number and email address provided, and will be required to respond within forth-eight (48) hours indicating whether he or she can accept the prizes. You acknowledge and agree that the notification phone call will be recorded and played live on air on 98.5 The Sports Hub, and you consent to such recording and on air broadcast of the call.  If the potential winner does not respond to the notification within the forty-eight (48) hour time period, the prizes will be forfeited and an alternate potential winner will be randomly selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above. Sponsor shall have no liability for any potential winner's failure to receive notices, including related to suspended or discontinued Internet, wireless, or land-line phone service or a change in an entrant’s email, phone number or mailing address which may result in a potential winner not receiving initial prize notification or his or her prize information. 

The receipt by a winner of the prizes offered in this Sweepstakes is conditioned upon compliance with these terms and conditions and any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL TERMS AND CONDITIONS BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. RIGHTS GRANTED BY YOU: Acceptance of any portion of the prizes constitutes winner's permission for Sponsor and any Sponsor Entity (as defined below) to use winner's name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation, except where prohibited by law. Each entrant also consents to being placed on the marketing list(s) of each Sponsor Entity for promotional and other materials (either by mail or by email) unless you have indicated otherwise by opting out of receiving such promotional material. By entering the Sweepstakes, you agree to release, discharge and hold harmless Sponsor Entities and their affiliates in the Sweepstakes or any Sweepstakes-related activities and the acceptance and use, misuse, or possession of the prizes awarded hereunder. Sponsor Entities assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes Entries or entry forms; or alteration of Entries or entry forms.  “Sponsor Entities” shall include Sponsor, Beasley Media Group, LLC d/b/a WBZ-FM, and each of their parents, affiliates, subsidiaries, licensees, distributors, dealers, sales representatives, retailers, individuals engaged in the development, production or distribution of materials, their advertising and promotion agencies, and any and all other companies involved in the Sweepstakes.

9. TERMS: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes should a non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these terms and conditions.

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, and to void entries for any reason.

Any attempt by an entrant to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Any other expenses or items not specifically listed in the prize description, including but not limited to, transportation, accommodations, meals, parking and souvenirs, are the responsibility of the winner. If the event or any portion thereof is postponed, rained out, canceled, or for other reasons beyond Sponsor’s control does not occur, Sponsor will not be responsible for replacing the ticketed or other related portions of the prize. Tickets are subject to certain terms and conditions specified thereon, and seat locations (if any) are as solely determined by Sponsor. Lost or stolen tickets will not be replaced. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the venue operator, prize provider or any other persons providing any prize-related services. If travel delays, cancellations or difficulty prevent arrival in time for the event, Sponsor is not responsible for awarding any compensation in lieu thereof. Tickets must be redeemed as stated in the prize notification or otherwise stated in these terms and conditions. Winner agrees to accept all space availability requirements established by the venue. Winner must comply with all applicable laws, and any rules and regulations established by the venue. Sponsor and the applicable venue representatives reserve the right to remove or to deny entry to winner (and his/her guest(s)) who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event or in any other objectionable behavior. Winner agrees that acceptance of the prize is done so entirely upon their own initiative, risk, and responsibility. 

10. LIABILITIES: By entering you agree to release and hold harmless Sponsor, Sponsor Entities, and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; and (vi) any acts or omissions of any third party.

Without limitation of the above, you agree to release and hold harmless Sponsor, Sponsor Entities, and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses, including COVID-19 and the causes thereof, and sickness arising as a result of the entrant participating in the Sweepstakes and related activities, wherever, whenever or however the same may occur. You fully understand that (a) COVID-19 is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition.

11. DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, you agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than your actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and you further waive all rights to have damages multiplied or increased.

13. WINNERS LIST REQUEST: To obtain a copy of the winner's name or a copy of these terms and conditions, mail your request along with a stamped, self-addressed envelope to: Encore Boston Harbor, 1 Broadway, Everett, MA 02149, Attn: Jacqui Krum.  Requests must be received no later than March 1, 2023.
