Encore Boston Harbor Sweepstakes

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. 

1. ELIGIBILITY: This Sweepstakes (“Sweepstakes”) is open to all legal residents of the 50 United States or the District of Columbia that are twenty-one (21) years of age or older as of the date of entry. The Sweepstakes is void where prohibited by law. Employees of Wynn MA, LLC (“Sponsor”) and its affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each of the foregoing are not eligible to participate in the Sweepstakes. The term “you,” as used in these terms and conditions, means any person who submits an entry. 

2. AGREEMENT TO RULES: By participating, you agree to be fully and unconditionally bound by these terms and conditions, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws. 

3. DATE OF SWEEPSTAKES: The Sweepstakes begins at 12:00 a.m. on March 27th, 2024, and ends at 6:00 p.m. on March 31st, 2024. Sponsor’s database computer is the official time-keeping device for this Sweepstakes.

4. HOW TO ENTER: There are two (2) ways to enter: 

  1. Spa Purchase: Earn one (1) entry for each ninety (90) minute (or longer) massage or therapy session purchased at the Spa at Encore Boston Harbor with a minimum price of $295 (not including tax or gratuity) between March 27th, 2024 and March 31st, 2024 for services occurring on March 31st, 2024 during normal business hours. Bookings made outside of the period referenced above, existing bookings, bookings for services occurring on days other than March 31st, 2024, and bookings less than $295 (not including tax or gratuity) are not valid for entry. Entrants must provide a valid phone number and email address.
  2. Write-In: To enter without making a purchase, legibly handwrite your complete name, mailing address, phone number and date of birth and mail a postcard or a card that is no smaller than 3 ½ x 5 inches and no larger than 4 ¼ x 6 inches, with proper postage to: Sweepstakes Entry, Attn: Jacqui Krum, Encore Boston Harbor, 1 Broadway, Everett, MA 02149. All write-in entries must be postmarked by March 30th, 2024 and received by March 31st, 2024. There is a limit of one (1) write-in entry per envelope/postcard, and one (1) write-in entry per entrant per day. Each envelope/postcard is considered one (1) entry into the Sweepstakes. Multiple entries submitted or completed by anyone other than the entrant are void. No mechanical reproductions will be accepted. Write-in entries must contain all entry fields outlined above; otherwise, they are void and will not be eligible to win. Sponsor is not responsible for late, lost, incomplete, corrupted, misdirected entries, or for computer or computer network errors at any point. Use of automated devices or “bots” is prohibited. Sweepstakes entries become the property of Sponsor and will not be returned.  If you use fraudulent methods or otherwise attempt to circumvent these terms and conditions, your submission may be removed from eligibility at the sole discretion of Sponsor. The authorized subscriber of the e-mail account used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant and must comply with these terms and conditions in the event of a dispute as to entries submitted by multiple users having the same e-mail account. The authorized account subscriber is the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses.       



5. PRIZES: One (1) potential winner will be randomly drawn from all eligible entries received. Winner will receive: 

  • One (1) ninety (90) minute Couple’s massage at the Spa at Encore Boston Harbor (up to $680)

Total approximate retail value of the prize: $680

Note: 

• The prize must be booked and completed within one-hundred-and-eighty (180) days of the notification to the winner.

• Winner and winner’s guest for treatment must be at least twenty-one (21) years of age. Guest must also agree to and accept these terms and conditions in order to share in the prize.  Entrant is responsible for making these terms and conditions available to guest. 

• Prize booking is subject to availability.

No cash or other prize substitution will be permitted except at Sponsor's discretion, including Sponsor’s right to substitute a prize of equal or greater value if the advertised prize is unavailable.  Prizes are subject to availability and blackout dates. All prizes are nontransferable.  The winner and guest shall be solely responsible for any and all prize-related expenses and fees, including, without limitation, any and all federal, state and/or local taxes (including sales tax). The potential winner shall be responsible, where applicable, to complete and execute an IRS Form 1099, an affidavit of eligibility, and  release and waiver liability form in order to receive the prizes, which may require the potential winner to provide his or her Social Security number for purposes of the same, within forty-eight (48) hours of receipt. Subject to verification of eligibility and compliance with these terms and conditions, including verification that the winner is twenty-one (21) years of age or older, the potential winner will be declared an official winner of the Sweepstakes. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older prior to winner notification, then the potential winner will be disqualified and an alternate potential winner will be randomly selected.

The prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).



6. ODDS: The odds of winning depend on the number of eligible entries received. 

7. WINNER SELECTION & NOTIFICATION:  All prizes will be awarded. The potential winner of the Sweepstakes will be selected in a random drawing under the supervision of Sponsor on April 17th, 2024. The potential winner will be notified by phone or by email to the phone number or email address provided at the time of entry, and will be required to respond within seventy-two (72) hours indicating whether he or she can accept the prizes. If a potential winner does not respond to the notification within the forty-eight (48) hour time period, the prizes will be forfeited by that potential winner and an alternate potential winner will be randomly selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above. Sponsor shall have no liability for any potential winner's failure to receive notices, including related to suspended or discontinued Internet or wireless service, or a change in an entrant’s email, phone number or mailing address which may result in a potential winner not receiving initial prize notification or his or her prize information. 

The receipt by a winner of the prizes offered in this Sweepstakes is conditioned upon compliance with these terms and conditions and any and all federal and state laws and regulations. ANY VIOLATION OF THESE TERMS AND CONDITIONS BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED

8. RIGHTS GRANTED BY YOU: Acceptance of any portion of the prizes constitutes winner's and winner’s guest’s permission for Sponsor and any Sponsor Entity (as defined below) to use winner's and guest’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation, except where prohibited by law. Each entrant also consents to being placed on the marketing list(s) of each Sponsor Entity for promotional and other materials (either by mail or by email) unless you have indicated otherwise by opting out of receiving such promotional material. By entering the Sweepstakes, you and your guest agree to release, discharge and hold harmless Sponsor Entities and their affiliates in the Sweepstakes or any Sweepstakes-related activities and the acceptance and use, misuse, or possession of the prizes awarded hereunder. Sponsor Entities assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes Entries or entry forms; or alteration of Entries or entry forms.  “Sponsor Entities” shall include Sponsor and its parents, affiliates, subsidiaries, licensees, distributors, dealers, sales representatives, retailers, individuals engaged in the development, production or distribution of materials, its advertising and promotion agencies, and any and all other companies involved in the Sweepstakes.

9. TERMS: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes should a non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these terms and conditions.

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, and to void entries for any reason.

Any attempt by an entrant to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Any other expenses or items not specifically listed in the prize description, including but not limited to, transportation, accommodations, meals, parking and souvenirs, are the responsibility of the winner. If the event or any portion thereof is postponed, rained out, canceled, or for other reasons beyond Sponsor’s control does not occur, Sponsor will not be responsible for replacing the ticketed or other related portions of the prize. Tickets are subject to certain terms and conditions specified thereon, and seat locations (if any) are as solely determined by Sponsor. Lost or stolen tickets will not be replaced. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the venue operator, prize provider or any other persons providing any prize-related services. If travel delays, cancellations or difficulty prevent arrival in time for the event, Sponsor is not responsible for awarding any compensation in lieu thereof. Tickets must be redeemed as stated in the prize notification or otherwise stated in these terms and conditions. Winner and guest agree to accept all space availability requirements established by the venue. Winner and guest must comply with all applicable laws, and any rules and regulations established by the venue. Sponsor and the applicable venue representatives reserve the right to remove or to deny entry to winner (and his/her guest(s)) who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event or in any other objectionable behavior. Winner and guest agree that acceptance of the prize is done so entirely upon their own initiative, risk, and responsibility. 

10. LIABILITIES: By entering you (and your guest) agree to release and hold harmless Sponsor, Sponsor Entities, and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; and (vi) any acts or omissions of any third party.

Without limitation of the above, you (and your guest) agree to release and hold harmless Sponsor, Sponsor Entities, and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses, including COVID-19 and the causes thereof, and sickness arising as a result of the entrant participating in the Sweepstakes and related activities, wherever, whenever or however the same may occur. You and guest fully understand that (a) COVID-19 is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition.

11. DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, you and guest agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will you or your guest be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than your or your guest’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and you and your guest further waive all rights to have damages multiplied or increased.

13. WINNERS LIST REQUEST: To obtain a copy of the winner's name or a copy of these terms and conditions, mail your request along with a stamped, self-addressed envelope to: Encore Boston Harbor, 1 Broadway, Everett, MA 02149, Attn: Jacqui Krum.  Requests must be received no later than June 1, 2024.
